TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of 3mailit.com and services provided by Fahrenheit674, inc., doing business as 3mail it (“3mail it,” “we,” “us,” or “our”).
By using this website or purchasing services from 3mail it, you agree to these Terms and any separate proposal, scope of work, order, or service agreement applicable to your project.
Our Services
3mail it provides creative and production services for publisher-sent email campaigns.
Services may include campaign strategy, email copywriting, subject lines, preheaders, email design, image preparation, calls to action, responsive HTML development, publisher specification review, final production files, Campaign Data powered by QSL2, and related services.
The specific services included in a project will be stated in the applicable proposal, order, or agreement.
Submitting a Form Does Not Create a Contract
Submitting a contact form, scheduling a campaign call, or providing campaign information does not create a service agreement, reserve production time, guarantee availability, or require 3mail it to accept a project.
A project begins only after the applicable scope, pricing, terms, payment requirements, and schedule have been agreed upon.
Client Responsibilities
You are responsible for providing accurate campaign information, current publisher requirements, required deadlines, necessary approvals, and materials needed to perform the agreed services.
You are also responsible for ensuring that claims, offers, prices, legal language, disclaimers, and other information you provide are accurate and lawful.
You represent that you have the necessary rights to use and provide all logos, images, copy, trademarks, photographs, videos, documents, data, and other materials supplied to 3mail it.
Publisher Requirements and Approval
3mail it does not control the publication, newsletter, association, media company, email service provider, or other third party responsible for sending your campaign.
The publisher or sender may accept, reject, edit, delay, reschedule, or decline campaign creative according to its own policies and requirements.
3mail it does not guarantee publisher approval or campaign deployment.
Project Scope
The services included in your project will be based on the agreed scope.
Requests outside the original scope may require additional fees, additional time, or a revised agreement.
Examples may include substantial changes in campaign direction, a new offer, additional versions, new placements, new landing pages, additional revision rounds, additional HTML versions, or material changes to publisher requirements after work has begun.
Revisions
The number of included revision rounds, if any, will be stated in the applicable proposal or agreement.
A revision round means one consolidated set of feedback submitted at one time.
Additional revision rounds may be billed separately.
Client Delays
Project schedules depend on timely client responses, approvals, materials, and payments.
If required information or feedback is delayed, project deadlines may also change.
3mail it is not responsible for missed publisher deadlines caused by delayed client materials, approvals, payments, or instructions.
Rush Work
Rush production may be available depending on project scope and current workload.
Rush work may require an additional fee.
Accepting a rush project does not guarantee that a third-party publisher will meet its own review or deployment schedule.
Fees and Payment
Fees, deposits, payment schedules, and payment methods will be stated in the applicable proposal, order, or agreement.
Unless otherwise agreed, invoices are due according to the payment terms stated on the invoice.
3mail it may pause or withhold work when payments are overdue.
Cancellation
Cancellation terms, deposits, and refunds will be governed by the applicable proposal, order, or service agreement.
Work already completed or time already reserved may be non-refundable.
Intellectual Property
After full payment, you will receive the rights to use the approved final deliverables as described in the applicable agreement.
Preexisting intellectual property, software, templates, tools, licensed materials, fonts, stock assets, third-party components, unused concepts, internal working files, and other materials not expressly transferred remain subject to their existing ownership or license terms.
Unless otherwise agreed, source files and unused concepts are not automatically included in the final deliverables.
Portfolio Use

Option A — You want the right to show completed work:
Unless otherwise agreed in writing, 3mail it may display completed public-facing campaign creative in its portfolio, website, presentations, or marketing materials after the campaign has been publicly deployed.
Option B — You do not want this right by default:
3mail it will not publicly display client campaign creative without permission.
Campaign Data Powered by QSL2
Campaign Data powered by QSL2 is an optional third-party service.
QSL2 services may be subject to separate terms, policies, technical requirements, pricing, and limitations.
3mail it does not guarantee any specific level of campaign activity, data availability, click volume, conversion volume, or other performance result.
You are responsible for ensuring that your use of Campaign Data complies with applicable laws, disclosures, contractual obligations, and privacy requirements.
No Performance Guarantee
3mail it does not guarantee campaign delivery, inbox placement, open rates, clicks, conversions, leads, registrations, purchases, revenue, return on investment, or any other marketing result.
Campaign performance depends on many factors outside our control, including the audience, sender, offer, timing, subject line, landing page, market conditions, technical environment, and recipient behavior.
Third-Party Services
Our services may rely on third-party providers, including scheduling systems, hosting providers, payment processors, QSL2, software platforms, and other vendors.
3mail it is not responsible for interruptions, outages, changes, errors, or failures caused by third-party services outside our reasonable control.
Website Content
The information on 3mailit.com is provided for general informational purposes.
We may update, change, or remove website content, services, features, or descriptions at any time.
Prohibited Use
You may not use our website or services for unlawful, fraudulent, deceptive, abusive, infringing, or unauthorized purposes.
You may not knowingly provide materials that violate another party’s intellectual property, privacy, contractual, or other rights.
Disclaimer of Warranties
To the fullest extent permitted by law, the website and services are provided on an “as is” and “as available” basis, except for any express commitments contained in a signed agreement.
3mail it disclaims warranties that are not expressly stated in an applicable agreement.

To the fullest extent permitted by applicable law, 3mail it will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the website, services, campaign performance, publisher actions, or third-party services.
Any additional limitations of liability should be stated in the applicable service agreement.
Indemnification
You agree to be responsible for claims arising from materials, instructions, claims, offers, or information you provide when those materials or instructions violate applicable law or the rights of another party.
Any additional indemnification obligations may be included in the applicable service agreement.
Governing Law
These Terms will be governed by the laws of the State of [STATE], without regard to conflict-of-law principles.
